This Privacy Policy (the “Privacy Policy” or “Policy”) describes the types of information Mindflow AI Inc. and its affiliates (“Mindflow AI,” “we,” “our,” or “us”) collect and process from and about you.
Except as described below, the Policy applies to all websites, mobile applications, and any other electronic/digital products or other services that are made available by Mindflow AI and that link to this policy, and our offline services (collectively, the “Services”).
Undefined capitalized terms used in this Policy have the meaning set forth in the Mindflow AI Terms of Use found at https://mindflowai.app/terms.
INFORMATION WE COLLECT
Information you provide directly to us.
We collect information directly from you. For example, you provide us with information when you use the Services, communicate with us, register for an account, subscribe to our blog or newsletters, or participate in our community, social media discussions, or promotions. Information you provide directly to us may concern you and others and may include:
- (i) Identifiers, such as your name, email address, password, phone number, display name, or username;
- (ii) Demographic information, such as your date of birth, general geolocation information, or timezone;
- (iii) Interests, such as topics you like to discuss;
- (iv) Inferences, such as preferences based on account settings, feedback on the Services, or your use of the Services over time;
- (v) Financial information, such as payment information and other information collected through our payment processing vendors;
- (vi) Commercial information, such as purchases and transaction history;
- (vii) Your content you submit, such as chat communications, posted images or videos, and biography descriptions;
- (viii) Voice data, including recordings of your voice, if you choose to use certain voice features; and
- (ix) Contents of communications with us, such as customer support messages.
Information you provide directly to us might also include information that may be treated as sensitive under applicable laws, such as login credentials, personal communications received or sent using our Services, or other information about yourself that you choose to provide when using our Services (e.g., if you voluntarily post user content revealing your race, religion, or sexual orientation). Sensitive personal information is not required or necessary to use the Services — please do not include any sensitive personal information in your interactions with us or the Services.
Information we collect about your use of the Services.
We and our third-party providers use cookies and other tracking technologies to collect information about your use of the Services. Please note that the specific tracking technologies and third-party providers may vary depending on where you are located and whether you access the Services via our websites or mobile applications.
As described further in the Cookie Policy, we use these technologies to collect and analyze device, Internet, and other electronic network activity information including information about your computer or device (e.g. device type; browser type; ISP or operating system; IP address; device identifiers such as IDFA, Android ID, etc.; version of our Services you are using); information about how you use and interact with the Services (e.g., domain name; access time; referring or exit pages; page views; Service-related identifiers such as User ID, Chat ID, Session ID, etc.; and actions taken within the Services); and geolocation data.
Information we collect from other sources.
We may also collect information from other sources, such as when you are referred to us by another user. In this context, we may receive your name and contact details. We may also receive information from third-party platforms, for example such as when you interact with our ads on other platforms, or when you interact with our social media profiles on platforms like Instagram or TikTok. Information we collect in this context includes information about how you interacted with our ads or the third-party platform; information about your device; demographic information (e.g., age, interests); and geolocation data.
We also collect information when you connect to your account using an account maintained by a third party, such as a social media account (“Third-Party Account”). The Services collect information about you from your Third-Party Accounts in accordance with your permissions. When you connect to us or log in through a Third-Party Account like Google, we receive information from that third party identifying your account. Information we collect in this context includes third-party account details such as username or email address. We collect and store this information and use it to help you connect to the Services. Connecting your account to a Third-Party Account is completely optional, and you will have the opportunity to grant permission when you attempt to connect. You can revoke permission by logging into the Third-Party Account and disconnecting Mindflow AI from there, and through the native applications on your mobile device. Please note that if you revoke permission for a Third-Party Account, we may retain the information we collected previously from the Third-Party Account provider (but the accounts will not be linked going forward).
We also collect information that is available on the Internet or from other publicly available sources to evaluate and improve our Services, including for model training and development.
HOW WE USE THE INFORMATION WE COLLECT
We use information for the following purposes:
- (i) Provide, administer, and operate the Services and our business;
- (ii) Generate and analyze inferences about use of the Services, such as your preferences and interests and trends about our Services (e.g., which portions of the Services are used most frequently, how users navigate the Services, and what our users like or do not like);
- (iii) Tailor the Services to your preferences and interests;
- (iv) Evaluate the success of advertising campaigns;
- (v) Communicate with you, including to inform you about features or aspects of the Services we believe might be of interest to you;
- (vi) Communicate with you about changes to our terms, conditions, or policies; or to respond to your inquiries, comments, feedback, or questions;
- (vii) Analyze, maintain, improve, modify, customize, and measure the Services;
- (viii) Develop new features, programs, and services;
- (ix) Provide advertising and recruit new users, including provision of tailored advertising;
- (x) Authenticate your account credentials, as necessary to log you in to the Services and help protect the security of your account;
- (xi) Process payments;
- (xii) Detect and prevent fraud, criminal activity, or misuse of our Service, and to maintain the security of our IT systems, architecture, assets, customers, and networks; and
- (xiii) Comply with legal obligations and legal process and to protect our rights, privacy, safety, or property, and/or that of our affiliates, you, or other parties, including to enforce our Terms of Use and any other agreements or policies.
We combine information that we collect through the Services with information that we obtain from other sources. We may also aggregate or anonymize information collected through the Services. We use and disclose aggregated or anonymized data for a number of purposes, including without limitation for research and marketing purposes. To the extent we anonymize any data originally based on personal information so that it is no longer reasonably linkable to an individual or household, we maintain and use such data in de-identified form and will not attempt to re-identify the data (except for the purpose of confirming it is de-identified).
WHEN WE DISCLOSE THE INFORMATION WE COLLECT
We do not sell or rent your personal information to third parties; however, we may disclose information in any of the following circumstances:
Affiliates.
We disclose information to our affiliates and subsidiaries, who may use the information we disclose in a manner consistent with this Policy.
Vendors and Service Providers.
We disclose information to employees, consultants, service providers, and other vendors who need access to such information to carry out work or perform services on our behalf, such as those who provide data storage, payment, technology support and services, customer service, analytics, fraud prevention, content moderation, legal services, and marketing and advertising services.
Safety and Protection of Mindflow AI and Others.
We may disclose certain information if we believe in good faith that doing so is necessary or appropriate to (i) protect or defend Mindflow AI or other parties, including to defend or enforce this Policy, our Terms of Use, or other policies, or any other contractual arrangement; and/or (ii) protect the rights, property or personal safety of Mindflow AI, or agents and affiliates, our employees, users and/or the public.
Your Content.
Certain actions you take might result in your content being made available to others.
Legal Requirements.
We may disclose certain information if we believe in good faith that doing so is necessary or appropriate to comply with any law enforcement, legal, or regulatory process, such as to respond to a warrant, subpoena, court order, or other applicable laws and regulations.
Business Transfers.
We may disclose certain information, in connection with or during negotiations or closing of any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
Other Disclosures with Consent or at Your Direction.
We might make additional disclosures of your information to third parties when you direct us to do so. For example, where you direct us to disclose information about you when you refer us or our Services to your friends or other acquaintances.
YOUR CHOICES
We offer you certain choices regarding the collection, use, and disclosure of your personal information.
Viewing history in-app.
Depending on the features available to you, you may be able to view some prior conversations or summaries in the app. Full in-app access to your entire conversation history is not guaranteed.
Profile information.
You may delete your account through the app. When you do, we will delete your personal data, including conversation records, from our active systems. Deleting your account does not cancel any active subscriptions. You can manage your subscriptions via the relevant payment processor (e.g., Apple App Store or Google Play Store). You may also verify, correct, update, or delete certain of your information through your account profile page.
Marketing communications.
You can unsubscribe from marketing emails by following the directions in those emails. Please note that if you unsubscribe from marketing emails, we may still send you administrative emails regarding the Services, including, for example, notices of updates to our Terms of Use or this Policy.
Cookies and tracking technologies.
Mindflow AI uses cookies and other tracking technologies to (i) understand app usage and improve functionality, (ii) deliver a seamless and personalized experience, and (iii) remember your preferences and settings. Depending on where you live and the options available on your device, you may have the ability to manage the cookies in use through your device or settings.
Rights to information about you.
Depending on where you live and subject to applicable exceptions under local law, you may have the following rights:
- (i) To request information about our processing of your personal information;
- (ii) To request access to and/or a copy of personal information we hold about you (including in a portable and/or machine-readable format);
- (iii) To object to how we process your personal information;
- (iv) To opt out of sales of personal information or targeted advertising;
- (v) To update or correct your personal information;
- (vi) To request that we delete certain personal information we hold about you;
- (vii) To restrict how we process certain personal information about you;
- (viii) To request that we transfer your information to a third-party provider of services;
- (ix) To withdraw consent for the processing of your personal information, when under applicable laws you had previously provided consent; and
- (x) The right not to be discriminated against for exercising your rights.
Please note that certain information may be exempt from such requests under applicable law. For example, we may retain certain information for legal compliance and to secure our Services. We may need certain information in order to provide the Services to you; if you ask us to delete it, you may no longer be able to use the Services.
If you would like information regarding your rights or would like to exercise any rights you may have under applicable law, email us at [email protected]. To protect your privacy and security, we take reasonable steps to verify your identity and requests before granting such requests. If we are unable to verify your identity, we may be unable to respond to your requests.
CHILDREN’S PRIVACY
The Services are not designed for minors under 13, and our Terms of Use prohibit use by anyone under 13. We do not knowingly collect personal information from children under 13. Depending on your location, additional protections may apply to minors under 16 or 18 in accordance with applicable state law. If we learn that we have collected personal information from a child under 13, we will take steps to delete that information.
DATA RETENTION
We keep your information for the time necessary for the purposes for which it is processed or as otherwise described at the time the information is collected, unless a shorter retention period is required by law. The length of time for which we retain information depends on the purposes for which we collected and use it and your choices, after which time we may delete and/or aggregate it. We may also retain and use this information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
LINKS TO THIRD PARTY WEBSITES
The Services may contain links to third-party websites or services. We are not responsible for the content or practices of those websites or services. The collection, use, and disclosure of your information by third parties will be subject to the privacy policies of the third-party websites or services, and not this Policy. We urge you to read the privacy and security policies of these third parties before providing information to them.
Voice Processing Technology.
Mindflow AI uses advanced voice processing technologies to enable our AI to understand and respond to your communication to emulate natural conversation. This means:
- (i) Voice interactions are processed through secure third-party systems.
- (ii) Voice data is converted to text format for processing and storage.
- (iii) Your conversation data is stored and made available to you within the app.
- (iv) By using voice features, you consent to the capture and processing of audio for transcription.
While we have agreements in place with our technology providers to protect your information, their processing of your data is also subject to their own privacy policies.
CHANGES TO THIS POLICY
We may update this Policy from time to time. We will indicate the date of the most recent update in this Policy. If we make a material change to the Policy, you will be provided with appropriate notice in accordance with legal requirements such as by email or prominent posting on our website or mobile application. Material changes will take effect no sooner than thirty (30) days after such notice is provided. Your continued use of the Services after the effective date of any changes constitutes your acceptance of the updated Policy.
